Island Green Sandestin, Florida – Citibank Luxury Short Sale Approved

This lovely home in Island Green, an elegant neighborhood within the community of Sandestin Resort, Miramar Beach, Florida, was just approved as a short sale.  Listed at almost $900,000, the luxury property went under contract in little more than 30 days.  Only the junior lien, Citi, was a short sale.  The following documents are typical of what is required for a short sale approval:

  1. Letter of authorization to allow me to speak on behalf of the owners to the bank
  2. Hardship letter outlining why a short sale is requested (some examples of hardship are job loss, death of breadwinner, medical expenses, mortgage payment re-set, relocation, divorce, etc.)
  3. Uniform Borrower Assistance form, which is a detailed financial worksheet itemizing expenses, income and assets of the owner
  4. Proof of income, for example, paystubs, profit and loss statement, alimony, child support, retirement income, social security income, pension, unemployment compensation
  5. Tax returns and/or IRS Form 4506T allowing the lienholder to obtain the specified tax documents from the IRS
  6. Bank statements– all savings, checking account statements typically for last 60 days, or longer, often kept up-to-date throughout the short sale approval process
  7. Supplement hardship documentation, such as medical bills, divorce decree, military PCS orders, etc.
  8. Payoff statements from other lienholders, such as the payoff from senior, junior liens or homeowners association liens
  9. Preliminary Closing disclosure (CD) or settlement statement (HUD) using the anticipated closing date
  10. Listing agreement
  11. Contract for purchase
  12. Proof of funds for buyer of short sale, either a pre-approval letter for a loan, or bank statement or letter from bank stating cash funds are available

This luxury Sandestin Florida short sale was approved in about 90 days and is scheduled to close in October.  The short sale approval letter from Citibank came without the requirement to pay back any deficiency. Note: there may be tax consequences of a short sale, since the IRS may view the forgiven debt as income. Always consult with your tax advisor and attorney when considering a short sale.

Lunch at Mitchell’s Fish Market – Grand Boulevard Sandestin

Mitchells Grand Boulevard Review

Yesterday was time for a Sandestin lunch adventure!  This time it was at Mitchell’s Fish Market on Grand Boulevard! My friend, Rhonda, and I headed to Sandestin thinking we might stop at Travinia Italian Kitchen, but ended up driving around and around trying to find a parking spot. Apparently, an expansion to Grand Boulevard with construction in progress was causing all the activity and parking spots to be filled up. There is a new building going up across from Carmike Boulevard 10 Cinema that will house Anthropologie and Vineyard Vine’s and the area was partially blocked by equipment, so we decided to go to Mitchell’s Fish Market, Seafood Restaurant and Bar instead. Surprisingly, it was not crowded.

The atmosphere is always lovely in Mitchell’s. It’s sleek, dark and nautical.  There are wood blinds along all the windows and sultry, oversized booths.  There was one private room up front where I’ve held company holiday parties (it holds about ten people), and that room was actually filled. Rhonda and I admired Mitchell’s menu with so many seafood offerings.  We decided to share the seared ahi tuna as an appetizer.  It was about $13.  At many restaurants around Destin, you’ll only get about five to seven slivers of tuna.  Mitchell’s was different!  Count them – ten tasty, somewhat spicy, strips of ahi tuna (there are no calories, you know?).  It came with rice and sliced cucumber salad. For the main courses, Rhonda got stuffed shrimp and I had cedar-planked cod with asparagus and zucchini. (You can order fish grilled, blackened, broiled, or pan-seared – cedar plank or Shanghai style). Rhonda thought I was crazy ordering a non-local fish (they had grouper), but I guess I was homesick for New England.  The cod had a plethora of sun-dried tomatoes as a topping and was very flavorful.  I would say that the cedar infusion dominated the palate and it was unique (it was not my favorite preparation).  Rhonda found her three stuffed shrimp very satisfying (ok, she was “stuffed”, too!). We didn’t get dessert, but the coffee was delicious!

DESTIN

  • Sunday, November 15 (11:00 AM – 4:00 PM) – ARTWalk (HarborWalk Village) | Features dozens of local artisans and craftspeople along this open air waterfront boardwalk. It’s a vibrant marketplace, bustling with street performers and live music.
  • Thursday, November 19 (5:30-8:00 PM) – 3rd Annual Bourbon at the Bay (Regatta Bay Golf & Yacht Club) | Sip on bourbon, scotch, and champagne, enjoy hors d’oeuvres, and start your holiday shopping early with their silent auction.
  • Friday, November 20 (6:00-8:00 PM) – Santa’s Arrival (Destin Commons) | Destin Commons and Bass Pro Shops welcome Santa to light the tree! Character photo opportunities and live entertainment with Sinfonia and festive carolers. Sit back and marvel at a holiday parade with Santa and fireworks!
  • Thursday, November 26 (11:00 AM – 7:00 PM) – Thanksgiving with Harbor Docks and Habitat (Harbor Docks) | Harbor Docks will open their doors for the 21st Anniversary of Thanksgiving with Habitat for Humanity to provide a complimentary traditional dinner for you. This invitation is open to everyone, whether you plan to spend the holiday alone or with family and friends.
  • Thursday, December 3 (6:00-7:00 PM) – Destin Christmas Tree Lighting (Destin Community Center) | The 29th Annual Christmas Tree Lighting is hosted by the City of Destin. This will be an outdoor event for the entire family with a visit from Santa Claus. There will be entertainment from local choruses, musical groups, dancers, etc., with refreshments being served after the lighting of the tree. Donations of toys and canned food will be collected for families in need.
  • Friday, December 4 (7:00 PM) – Sounds of the Season Christmas Concert (Village Baptist Church) |  Doors open at 6:00 PM. Admission is a donation of an unwrapped child’s toy to be distributed among the participating churches’ outreach ministries to provide a brighter Christmas for families in need during the holidays. A love offering at intermission will benefit Mattie Kelly Arts Foundation’s “All Kinds of Art,” a children’s educational outreach program inspiring students and special needs children in Okaloosa and Walton Counties.
  • Saturday, December 5 (2:00-4:00 PM) – Emerald Coast Theatre Company’s “A Dickens Christmas” (HarborWalk Village: Veranda Room) | Experience a unique adaption of Charles Dickens’ famous story “A Christmas Carol” in this up close and intimate setting. Three talented professional actors seamlessly change from character to character as they bring to life the tale of Scrooge and his transformational night with three ghosts. Make this special evening a new holiday tradition as you share cookies and tea with family and friends in a cozy, festive atmosphere.

There are 26 homes for sale in Burnt Pine and 27 building lots for sale. The homes are listed from $824,000 to $3,900,000. Lots are listed from $190,000 to $1,500,000.

Just Sold Villa Lago Lot 127, Sandestin Florida Short Sale 32550

Lot 127 Villa Lago in Sandestin, Florida resort,  just sold! The Baytowne Loop parcel was a short sale with Bank of America.  The listed price for this Villa Lago lot was $65,500. The sale price was $65,000. The property had some past due association fees.  Bank of America paid about $8,000 of the past due fees. The buyer contributed about $2000.  The homeowners associations reduced their final balances due to allow the closing and also to settle in full.  There were two HOA’s in this case – Villa Lago Homeowners Association and the Sandestin Master Association.  I find homeowners associations normally work with sellers in a short sale situation. Why would they reduce the amount of their bill and settle for less?  First,  according to Florida Statutes 72.3805:

Notwithstanding anything to the contrary contained in this section, the liability of a first mortgagee, or its successor or assignee as a subsequent holder of the first mortgage who acquires title to a parcel by foreclosure or by deed in lieu of foreclosure for the unpaid assessments that became due before the mortgagee’s acquisition of title, shall be the lesser of:

1. The parcel’s unpaid common expenses and regular periodic or special assessments that accrued or came due during the 12 months immediately preceding the acquisition of title and for which payment in full has not been received by the association; or

2. One percent of the original mortgage debt.

What does this mean? That if a Florida property is foreclosed on, the foreclosing entity is only liable to pay an amount equal to the lesser of one year’s association dues or one percent of the borrower’s mortgage debt.  If they get anything more than this amount, as in a short sale where the lender pays part of the balance (and possibly the homeowner and the buyer), they might be pleased and accept it as settlement, instead of waiting for the owner to get a new buyer or pursuing the balance further legally.

Second, an HOA might settle for less than their full balance due so that they will get a new “paying” owner.  If not, they may have to wait months or maybe years for a regular payee.
