The other day I received a happy approval on a short sale lot in Santa Rosa Beach Florida.  The short sale lender PNC, had taken over the servicing on the loan from RBC Centura.  The original mortgage amount was about $550,000 in 2004.  Today, the value of the Santa Rosa Beach lot is about $70,000.

The seller was concerned we would not get an approval with such a huge monetary loss to PNC.  I said, “Let’s give it a try!”.  (I’ve gotten many short sales approved with high dollar losses.) The lot went under contract in about a week.  I already had a contact at PNC, so started the short sale process quickly by email.  The only documents that would be required were the HUD-1 settlement statement, the contract, buyer pre-approval and my listing agreement. The short sale was approved in two weeks!

The problem? The PNC negotiator could not get a waiver of deficiency What is that?  That means the seller would be liable for the almost $450,000 remaining debt on the loan.  He is in his 70’s and unable to pay this due to job loss and a very serious illness.  I asked the negotiator to go back to management one more time, and I highlighted the key points of my seller’s hardship letter. It explained in detail how the his disease would unfortunately cause his health worsen.  I also emailed the negotiator a link to the National Institute of Health website with a description of the illness.

Two hours later. Short sale approved – no deficiency! 

The Santa Rosa Beach couple was delighted. In fact, they came to meet me to thank me.  They brought a gift… a little crystal angel.  That meant more to me than I could express, and I told them.

My advice if you think you won’t be able to short sale? Never give up! Hire an experienced Santa Rosa Beach short sale agent who can guide you through to success, and on with your life.

Is Your Santa Rosa Beach Realtor Responsible for Lawn Care and Utilities?

 

Every once in a while I run into a situation where a Santa Rosa Beach FL short sale seller does not have the funds to keep their utilities on.  Their yard is overgrown. They cannot pay for lawn care.  When this is the case, what do you do?  I know agents who pay for customer’s utilities, lawn and other maintenance on a regular basis. They may consider this part of their cost of doing business if they are in the short sale specialty. That is fine, but I stopped paying for these types of items years ago.

I remember the first time I “paid” for someone’s water turn-on as a favor. They were to reimburse me.  Two bills later, they never did.  Sometimes you get a clue at the beginning of a transaction. Is the seller slow to send in short sale paperwork? Is it a strategic short sale?  These are the sellers who can afford to keep on utilities, but choose not to. They also may not be as committed to the sales process.  I just ran into this situation with a lock change in Santa Rosa Beach Florida.  The seller could not find his keys for an investment property he hadn’t seen in years.  He felt the short sale lender should pay for the lock change.  Would I step in and do it? No. Why not?  There had been other “clues” about the seller’s willingness to cooperate.  A serious and motivated seller is an integral part of the real estate sales process, short sale or not, and if that’s not the case, you probably shouldn’t take the listing.

So, what are some solutions to seller’s unwillingness or inability to maintain properties during the marketing period?  In the situation where a vacant, improved property’s yard becomes overgrown, and we get complaints from neighbors, what do we do? We state in our listing agreement that our sign will be removed, since the neighbors innocently expect the real estate company to also be the property management company. In the case where the seller does not turn on utilities, we state in the MLS: “Buyer is to turn on utilities for any desired inspections”. Most buyers understand the seller is in a financial predicament, and agree to pay. I’ve only had one problem with this over the years. The buyer did not have the funds either.  In that case, the seller agreed to reduce the earnest money requirement, and turn $100 back to the buyer for utilities.  Problem solved.

Chase Approves Driftwood Estates Short Sale – Loses a Bundle

Three months can make a big difference in a market place. 

Three Months Ago… Chase approved the short sale for this Driftwood Estates home in Santa Rosa Beach Florida.  The sale price at the time was $230,000.  But oops- the buyer’s lender only appraised the home for $220,000.  The buyer could not get a loan for $230,000. Despite providing Chase with the buyer’s appraisal, they refused to lower their approval amount to $220,000. They were stuck on the value and would not look at the big picture. The buyer walked.

Fast forward three months later.  The Driftwood Estates home was gradually reduced in price to $189,900, as the market dropped considerably in Santa Rosa Beach Florida.  There was an oil spill.  There was an oversupply of homes. But we found a new buyer, who offered in the $180’s…  Over $30,000 less than the last offer. Chase ordered a new Broker Price Opinion.  Guess what?  Even the short sale negotiator was suprised.  The new value, just three months later, was significantly lower – in the $180’s.  The short sale was approved.

Unfortunately, three months were wasted and $30,000 was lost.  Maybe Chase and its investors will  review their procedures and look at the big picture in the future.  Maybe not.

CitiMortgage Delays Destin Florida Foreclosures – Due to Oil Spill

Leading the mortgage industry, CitiMortgage has announced assistance for borrowers in financial trouble in the oil-threatened regions on the Gulf of Mexico.  This is good news for Destin, Fort Walton Beach, Santa Rosa Beach and Navarre Florida short sale sellers.  Citi is halting foreclosures on primary mortgages it owns through September 17.  Eligible borrowers include those within 25 miles of the affected coastal regions.

Why is this good news?  Destin short sale sellers will have more time to get their properties sold.  Santa Rosa Beach short sale buyers will know that their contracts on Citi-mortgaged properties will be processed for approval without foreclosure threat.  In addition, Citi is halting evictions on their foreclosed properties in the affected Emerald Coast areas.

The natural disaster looming in the Gulf of Mexico will put “unnatural” pressure on a real estate market still on the downslide. Even though there is a BP claims process in place (soon to be an independent party), there will be loss of income that is not accounted for and further job loss in the region.  Of course, that will spike borrowers inability to make payments or find other employment.

CitiMortgage is really stepping up by taking this action. Destin, Fort Walton Beach, Santa Rosa Beach and Navarre Florida short sale sellers working to avoid foreclosure will have a greater chance of success. What else can be done?  Other servicers and investors should follow suit.
