One of the key differences between a typical short sale and VA Compromise Sale is the disposition of the deficiency.  According to the VA website, “ If your loan closed on or after January 1,1990, you will owe the Government in the event of a default only if there was fraud, misrepresentation, or bad faith on your part.” So, in most cases, you will not have to pay back the difference between the net proceeds and your outstanding balance.

Another difference in the VA Compromise program is the length of time the VA appraisal stands. With most short sales, the servicing lender will order a valuation (either an appraisal or broker price opinion), that will be valid for two to three months. In the VA Compromise program, the valuation, conducted by a VA certified appraiser, is valid for six months.  That is not always good, especially in a declining market.  So if a sales contract does not get approved, the targeted price will have to stand, and not be adjusted even if competing properties are priced lower.

This home in Lighthouse Pointe had a Bank of America mortgage.  VA delegates the loan servicers to handle the compromise claims for them, so there is no need for the homeowner to contact the VA directly.  This approval only took 30 days!

A VA Compromise Sale is similar to a short sale.  If you have a VA mortgage,  and need to sell your Navarre, Crestview, Fort Walton Beach or Destin home because you can no longer afford your mortgage payments, you may qualify for a VA Compromise Sale.  Your mortgage balance must be higher than the market value or anticipated sales proceeds, and you don’t have the cash difference to bring to closing.

Some of the requirements for a VA Compromise Sale are:

 1. You may only sell the home for fair market value. This value will be determined after you submit a contract to your mortgage lender, who is delegated to handle your VA Compromise Sale.  The VA appraisal is valid for six months.

2. The closing costs must be “reasonable and customary”.  

3. You must have a valid financial hardship such as loss of income, relocation (such as PCS move to a new base), death of breadwinner, etc.

4. There should not be a second mortgage on your property, unless it is “insignificant”.  VA may allow a small amount to pay your junior lien, but you might have to make other arrangements.

One of the biggest questions I receive about VA Compromise Sales from Eglin AFB and Hurlburt Field Airmen is:

“Will I be responsible to pay back the deficiency from the sale?”

VA says no – “If your loan closed on or after January 1,1990, you will owe the Government in the event of a default only if there was fraud, misrepresentation, or bad faith on your part.”

Leading the mortgage industry, CitiMortgage has announced assistance for borrowers in financial trouble in the oil-threatened regions on the Gulf of Mexico.  This is good news for Destin, Fort Walton Beach, Santa Rosa Beach and Navarre Florida short sale sellers.  Citi is halting foreclosures on primary mortgages it owns through September 17.  Eligible borrowers include those within 25 miles of the affected coastal regions.

Why is this good news?  Destin short sale sellers will have more time to get their properties sold.  Santa Rosa Beach short sale buyers will know that their contracts on Citi-mortgaged properties will be processed for approval without foreclosure threat.  In addition, Citi is halting evictions on their foreclosed properties in the affected Emerald Coast areas.

The natural disaster looming in the Gulf of Mexico will put “unnatural” pressure on a real estate market still on the downslide. Even though there is a BP claims process in place (soon to be an independent party), there will be loss of income that is not accounted for and further job loss in the region.  Of course, that will spike borrowers inability to make payments or find other employment.

CitiMortgage is really stepping up by taking this action. Destin, Fort Walton Beach, Santa Rosa Beach and Navarre Florida short sale sellers working to avoid foreclosure will have a greater chance of success. What else can be done?  Other servicers and investors should follow suit.

I’ve sold real estate in Navarre Florida a long time. 

I was calling Homecomings Financial on the status of one of my Navarre short sales.  Of course, I going through the usual ninth-degree, name, rank and serial number before they would give me any information. Finally, the rep asks for the property address.  I told her 9478 Parker Place, Navarre Florida 32566.  She says, “That’s not the zip code we have”.  First I wondered if I called the wrong bank, or had the wrong property.  No, I quickly scanned my file and it was right.

I said, “Ma’am, Navarre has one zip code and it is 32566”.  Again, she repeated I was mistaken and she could not talk to me about the short sale.  OK, am I going nuts?  Maybe my listing wasn’t in Navarre, or there was a new zip code I didn’t know about.  I said, “Hold on, I’ll verify the zip code on the internet.”  Nope.  One zip code for Navarre, Florida.  Exasperated, I hung up and decided to do some digging.

I checked my physical file with payoff statement from Homecomings Financial. There it was. Their system had the Navarre Florida zip code wrong – 32568.  Done with the phone nonsense, I had my assistant call back.  She gave them the secret code- the wrong zip code, that is, and voila!  They would talk to her.  When she informed them they had the zip code wrong, they stated they would not change it unless my seller sent in a letter!  For some reason they could not check U.S. Postal Service themselves.

Regions Mortgage has approved a short sale in Holley by the Sea, Navarre, Florida.  Regions has branches primarily in the South and Midwest.  I have found they like to negotiate back and forth on short sales, more so than other lenders.  They normally want a cash contribution, promissory note, or both, and prefer to move their liens onto other of the borrower’s real estate assets.  Regions has gotten some press lately as one of the few lenders who is yet to repay TARP funds to the U.S. Treasury, as well as federal charges against its subsidiary, Morgan Keegan & Company.  Regions is fighting those charges.

They did recently approve this short sale in Navarre, Florida.

Property:  Single family home in Holley by the Sea

Mortgage:  Regions – balance about $210,000

Offer:  about $150,000

Cash Contribution:  $22,000
 
Notes:  Remainder of balance moved as collateral to another property
